Special Education and Medicaid Advocacy for Children in Institutions

This workshop will focus on advocating for the rights of special education students in institutions and Olmstead implementation for children with psychiatric disabilities. Presenters will discuss provisions of the Individuals with Disabilities Education Act that relate to students in institutions and other out-of-home settings, including foster care and juvenile justice placements. Presenters will also discuss a special education hearing decision against a state hospital in California that affirmed the obligation to provide a free and appropriate public education to all children with disabilities, regardless of placement. Finally, presenters will discuss Olmstead implementation for children with psychiatric disabilities through special education advocacy, Medicaid EPSDT and waiver services, and the Katie Beckett Option.
